Petitioner seeks bail in Jhajha P.S. Case No. 277/18 registered for the offence under Sections 147, 148, 149, 341, 323, 333, 353, 307, 504 of the Indian Penal Code and Section 3⁄4 of Explosive substance Act.
Allegation as per the F.I.R. is that in the night of 21.07.2018 on receipt of information that there was free fight between the two parties arising out of land dispute the informant along with the police party reached there and tried to pacify them but the petitioner and Karu Yadav hurled bomb and Rajesh Yadav and Dilip Yadav also hurled bomb on the informant as a result of which one police and one another person sustained injury. Police party arrested two persons including the petitioner who disclosed the names of all the accused persons who escaped from there.
Patna High Court Cr.Misc. No.61327 of 2018 (3) dt.31-10-2018 2/2 Submission on behalf of the learned counsel for the petitioner is that there was group rivalry in which only bombs were hurled and only two persons sustained injuries which are said to be simple in nature. It is further submitted that there is no specific allegation against the petitioner who happens to be the chawkidar and he is in jail custody since 23.07.2018 having no criminal antecedent.

Having heard both sides and in view of the facts and circumstances of the case, stated above, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of C.J.M., Jamui, in Jhajha P.S.Case No.277 of 2018.
