JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-09-2019 This application, for grant of anticipatory bail, arises out of Silao (Nalanda) P.S. Case No. 114/2019, disclosing offences under Sections 341, 323, 308, 325, 506 read with Section 34 of the Indian Penal Code.

Prosecution case is that while the informant was filling soil in his land, co-accused Ramakant Singh and others including petitioners came there and assaulted the informant by means of lathi and danda and when others came to save him, they were also assaulted by the accused persons. Submission of learned counsel for the petitioners is that there is case and counter case between the parties in the background of land dispute and furthermore, no specific

Having heard both sides, considering the facts and circumstances, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Silao (Nalanda) P.S. Case No. 114/2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
