JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 06-10-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 328, 379, 120(B)/34 of the Indian Penal Code.

The statement of victim was recorded at para-18 of the case diary and in the said statement he stated that he along with petitioner as well as co-accused had taken meal in a hotel and at that time petitioner gave him a Laddoo which was eaten by him but after that he lost his consciousness. The investigation against the petitioner has already been completed and petitioner is in jail custody since 08.11.2015.

No doubt, petitioner carries some criminal

No.30741 of 2016 (3) dt.06-10-2016 2/2 antecedent but considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhojpur at Ara in connection with Sikarahata P.S. Case No. 13 of 2015.
