JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 24-08-2016 Heard learned counsel for the petitioner and learned counsel representing the State.

The petitioner wants to renew his prayer of bail, which was earlier rejected vide order dated 04.11.2015 passed in Cr. Misc. No. 49252 of 2015 disposed of with Cr. Misc. No. 30756 of 2015, on the ground that the petitioner is in custody since 16.04.2015, there is no progress in the trial, in near future the trial is not likely to be concluded and the petitioner is also not getting proper treatment and as such he deserves sympathetic consideration to which the learned APP opposes by submitting that the petitioner received injury by unknown persons when he was trying to flee away after committing the crime. In the facts and circumstances stated above, at present, finding no good ground for reconsideration of prayer for bail of the petitioner, again his prayer for bail stands rejected.

No.33099 of 2016 (3) dt.24-08-2016 However, jail superintendent is directed to get the petitioner treated properly by taking all positive steps and the trial court is also directed to take all positive steps to conclude the trial as early as possible, preferably within nine months from the date of receipt/production of a copy of this order after taking the same on priority basis.
