JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-02-2017 The petitioner is apprehending his arrest in connection with Bettiah Town P.S. Case No. 175 of 2014, registered for offences punishable under Sections 25(1-b)A, 26 and 35 of the Indian Penal Code.
It has been submitted on behalf of the petitioner that his name come in this case only on the basis of confessional statement of co-accused of this case and so far as criminal antecedent of the petitioner is concerned, he has been falsely implicated in all those cases also.
Heard learned A.P.P.
Having heard both sides, in view of the fact that the case is under Section 25(1-b)A, and other Sections of Arms Act and also the petitioner has criminal antecedent as he is accused in as many as three other cases, I am not inclined to grant the petitioner,
Patna High Court Cr.Misc. No.4358 of 2017 (2) dt.13-02-2017 2/2 the privilege of anticipatory bail, it is accordingly rejected. However, if the petitioner surrenders and make prayer for regular bail, his application for bail will be considered by the learned Court below without being prejudiced by the order of this Court.
