JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-03-2017 The petitioner is apprehending her arrest in connection with Jamalpur P.S. Case No. 131 of 2016, registered for offences punishable under Sections 420, 467, 468, 471 /120B of the Indian Penal Code.
It has been submitted on behalf of the petitioner that allegation against the petitioner is that at the time of appointment as panchayat teacher, she produced certificate of intermediate, which was found forged on verification as in the said certificate in place of marks obtained 433 it was mentioned as 630 marks. However, for the appointment of the said panchayat teacher, only qualification of matric was required and there is no allegation that matriculation certificate was forged. It has further been submitted that other similarly situated persons have already been granted the
Patna High Court Cr.Misc. No.7231 of 2017 (3) dt.17-03-2017 2/3 privilege of anticipatory bail by this Court vide order dated 17.02.2017, passed in Criminal Miscellaneous No. 3070 of 2017, order dated 07.03.2017 passed in Criminal Miscellaneous No. 1367 of 2017 .
Learned counsel for the Vigilance Department opposed the prayer for bail and has submitted that at the time of appointment, the petitioner has submitted forged certificate of intermediate.
Having heard both sides, in view of the fact that qualification for appointment on the post of panchayat teacher was only matric and the allegation is that the petitioner has produced forged certificate of intermediate and also in view of the fact that other similarly situated persons have already been granted the privilege of anticipatory bail by this court and the petitioner is a lady, as such, let the petitioner above named, in the event of her arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bond of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-II, Munger in connection with Jamalpur P.S. Case No. 131 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
Patna High Court Cr.Misc. No.7231 of 2017 (3) dt.17-03-2017 3/3 This is further subject to the condition that;- (i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.
(ii) The petitioner shall cooperate in the investigation and make herself available as and when required by the police and on the event of failure on her part to appear before the police on two consecutive dates without showing any genuine reasons, the prosecution will be free to move for cancellation of her bail bonds.
