JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 09-09-2016 Heard learned counsel for the petitioner and learned counsel representing the State.

The petitioner seeks bail in connection with Sachiwalaya P.S Case No. 19 of 2016 registered for the offences punishable under Sections 467, 468, 471, 420/34 of the Indian Penal Code.

Allegedly, to provide Government job the petitioner took Rs. 22,000/- (twenty two thousand) and further Rs. 31,000/- (thirty one thousand), but no joining letter was provided to him. Submission is of false implication and that now the matter has been compromised. Other co-accused namely Ranbir Mahto and Pramod Kumar Mishra have been allowed bail by another co-ordinate Bench of this court and, as such, petitioner

Patna High Court Cr.Misc. No.31281 of 2016 (4) dt.09-09-2016 2/2 also deserves sympathetic consideration, to which the learned A.P.P. does not oppose.

In the facts and circumstances stated above, petitioner is directed to be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of the learned Chief Judicial Magistrate, Patna, in connection with Sachiwalaya P.S. Case No. 19 of 2016, subject to the conditions that one of the bailors must be near relative and another having sufficient immovable property within the territorial jurisdiction of the Court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
