2. The petitioner seeks pre-arrest bail in connection with Tajpur (Halai) P.S. Case No. 37 of 2023 registered for the offence(s) punishable under Sections 147, 149, 447, 341, 323, 307, 354(B), 379, 504 and 506 of the Indian Penal Code.

3. As per the allegation made in the FIR, the accused persons named therein including the petitioner have assaulted the informant, her husband and her son, as a result of which, they all sustained injury.

4. Learned counsel appearing on behalf of the petitioner submitted that petitioner is innocent and has falsely implicated in this case. It is further submitted that general and omnibus allegation has been levelled against the petitioner. It is further submitted that similarly situated co-accused persons have already been granted bail by a co-ordinate Bench of this Court vide order dated 28.07.2023, passed in Cr. Misc. No.40923 of 2023. Petitioner has clean antecedent.

5. Learned APP for the State vehemently opposed the prayer for grant of pre-arrest bail.

6. In the facts and circumstances of the case, the petitioner, above named, is directed to be released on pre-arrest bail, in the event of his arrest or surrender before the Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 1st Samastipur in connection with Tajpur (Halai) P.S. Case No. 37 of 2023, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.

7. The court below is directed to verify the criminal antecedent of the petitioner and if it is found that the petitioner is involved in some other cases, as what has been stated in

Patna High Court CR. MISC. No.60721 of 2023(3) dt.29-02-2024 3/3 paragraph no.3 of the bail application, this order will automatically lose its force.
