JUSTICE DINESH KUMAR SINGH ORAL ORDER 23-07-2015 Heard learned counsels for the petitioner and the State. The petitioner is languishing in custody since 14.1.2015 in a case registered for the offences punishable under Section 395 of the Indian Penal Code.

The informant's cash, ornaments and ATM Cards were robbed leading to registration of FIR against five unknown. Name of the petitioner sprang up during investigation. It is submitted by the learned counsel for the petitioner that there is no recovery from the petitioner nor the petitioner has been put on test identification parade. Statement to the aforesaid effect has been made in paragraphs 8 and 10 of the petition. Considering the fact that the petitioner has not been put on test identification parade and investigation has concluded, let

No.25749 of 2015 (2) dt.23-07-2015 2/2 the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Bikramganj, Rohtas in connection with Dawath P.S. Case No. 119 of 2014. Considering the criminal antecedent of the petitioner, the learned court below shall be at liberty to cancel the bail bonds of the petitioner in case the petitioner gets involved in serious offence or defaults without any reasonable cause on three consecutive occasions.
