2. The petitioner has prayed for bail in a case registered for the offence punishable under sections 498(A), 365/34 and 304(B) of the Indian Penal Code.
3. As per allegation in the FIR, petitioner along with his family members has tortured the informant's daughter due to non-fulfillment of additional dowry demand and ultimately she was being killed by throttling.
4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is husband of the deceased and has been falsely implicated in this case. He has never demanded any thing from the deceased or her family

Prior to the alleged occurrence, informant had visited to his daughter's matrimonial home for settling the dispute between the deceased and the petitioner. In para 60, 61 and 63 of the case diary, statement of the independent witnesses are available in which they have stated that deceased herself committed suicide by hanging and the information of her death was provided to her parents. Petitioner with support of his relatives has cremated her dead body in Buxar and receipt in respect of cremation, he has received from Buxar Nagar Parishad. Petitioner has got no criminal antecedent and languishing in judicial custody since 20.07.2022. The application for bail is opposed by learned APP for the State and learned counsel for the informant and submitted that petitioner is husband of the deceased and she died at her matrimonial home.
Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Buxar in connection with Sikraul P.S. Case
