This is the third attempt of the petitioner to seek bail in Sahar P.S. case no. 174 of 2014, registered under Sections 364, 302 and 201/34 of the IPC.
Under order dated 27.01.2016, the prayer for bail on the second occasion was declined by directing the learned trial Court to take steps for examination of all material prosecution witnesses within four months from the date of receipt/production of a copy of this order, failing which the petitioner was directed to be released on bail.
A status report was called for in this case which is placed at Flag- 'X'. On perusal whereof, it appears the case is
Patna High Court Cr.Misc. No.32049 of 2016 (3) dt.24-08-2016 2/2 now fixed for recording the statement of the accused under Section 313 Cr.P.C. In other words, the evidence of the parties has been closed.
Considering the above, this Court does not find any merit in this application for grant of bail Prayer is, accordingly, rejected.
