Petitioners are accused in Sessions Trial No. 572 of 2013 arising out of Bihpur (Jhanadapur) P.S. Case No. 392 of 2012 registered under Sections 147, 148, 149, 459, 323, 326, 307, 302 and 380 of the I.P.C.
Learned counsel appearing on behalf of the petitioners submits that earlier prayer of the petitioners and coaccused Karali Mian and Tanuka Mushehar for bail was rejected by this Court vide Cr. Misc. No. 30376 of 2013 on 29.01.2014. It is further submitted that similarly situated co-accused, Tanuka Mushahr and Karali Mian later on have been allowed bail by this Court vide Cr. Misc. No. 30376 of 2013 on 29.01.2014, as the cause of death of deceased was found head injury caused by sharp
Patna High Court Cr.Misc. No.24735 of 2015 (2) dt.01-07-2015 2/2 cutting weapon in F.I.R. It is alleged that co-accused Jyoti Singh and Tanina Mian were armed with axe. It is also submitted that petitioners are in custody since 05.02.2013.
Having considered the facts and circumstances of the case, let the above named petitioners be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of 1st Additional Sessions Judge, Naugachia in connection with S. Tr. No. 572 of 2013 arising out of Bihpur (Jhanadapur) P.S. Case No. 392 of 2012.
