The petitioner seeks transfer of Matrimonial Case No. 379 of 2013 pending in the Court of learned Principal Judge, Family Court, Patna to the Court of learned Principal Judge, family Court, Bhojpur at Ara.

Learned counsel for the petitioner submits that earlier notice had been issued to the opposite parties, but they have chosen not appear and contest the matter. He further submits that the petitioner is incapable in coming to Patna to contest the matter as she is facing acute financial exigency and also apprehends threats to herself and she is sufficiently tortured by the opposite parties.

Considering the aforementioned facts and

Patna High Court MJC No.1913 of 2014 (8) dt.20-06-2018 2/2 circumstances and that the petitioner has a genuine ground for seeking transfer of the case from Patna to Bhojpur at Ara where she normally resides.

Let the Matrimonial Case No. 379 of 2013 be transferred from the Court of Principal Judge, Family Court, Patna to the Court of Principal Judge, Family Court, Bhojpur at Ara. The records of the aforementioned case may be communicated forthwith to the concerned Court. The application stands allowed.
