JUSTICE SUDHIR SINGH ORAL ORDER 22-09-2015 Learned counsel for the petitioners is permitted to make necessary correction in the prayer portion of the petition. Heard learned counsel for the petitioners and learned counsel for the State The petitioners are apprehending their arrest in connection with Teghra P.S. Case No. 02/2015 for the offences instituted under Sections 498(A), 304(B) and 201/34 of the IPC. The accusation is of killing the daughter of the informant for non-fulfilment of dowry demand after two years of marriage.
It has been submitted on behalf of the petitioners that
Patna High Court Cr.Misc. No.25858 of 2015 (4) dt.22-09-2015 2/2 the petitioners have got no criminal antecedent. It is further submitted that the petitioner no. 1 is the father-in-law, petitioner no. 2 is the mother-in-law and petitioner nos. 3, 4 and 5 are the Dewars of the deceased. It is further submitted that the petitioners have been made accused in the present case due to mistake of fact. It is further submitted that vide Annexure-2 there is a U.D. case also instituted on behalf of the mother of the deceased prior to institution of the present case.
On behalf of the State it has been submitted that the petitioners are named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioners above named, be released on bail in the event of their arrest or surrender before the learned court below within a period of four weeks from today in connection with Teghra P.S. Case No. 02/2015 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Dalsingsarai, Samastipur, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
