The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 304B/120B of the Indian Penal Code.
Informant Baleshwar Paswan @ Balai Paswan gave his first fardbeyan on 27.04.2015, vide Annexure-2, to the police in Darbhanga Medical College and Hospital Police Station alleging therein that husband of the victim Sangita Devi was scuffling with his brother when Sangita Devi went for rescue she was thrashed and sustained serious injury and during the course of treatment she died. The same informant lodged the present case on 17.06.2015 with allegation that Sangita Devi was done to death for
Patna High Court Cr.Misc. No.5760 of 2017 (3) dt.23-03-2017 2/2 non-fulfilment of dowry demand.
Considering the conflicting statement of the informant, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Jhanjharpur, Madhubani/Successor Court in connection with Madhepur Police Station Case No.55 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. With further condition that petitioners shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioners in this case.
