We have perused the facts stated in the limitation petition and we find sufficient reason to condone the delay. The

Patna High Court L.P.A No.938 of 2019 dt.21-08-2019 2/3 delay is, accordingly, condoned and the appeal shall be treated to be within time.

I.A. No.01 of 2019 stands allowed accordingly. Re: L.P.A. No.938 of 2019 Heard learned counsel for the appellant.

This appeal arises out of a same judgment that was delivered in C.W.J.C. No.4235 of 2017 along with the writ petition filed by the appellant, being C.W.J.C. No.18048 of 2016. A letters patent appeal was filed by the petitioner of C.W.J.C. No.4235 of 2017, being L.P.A. No.723 of 2019 (Lakshmi Prasad Nayak Vs. The State of Bihar & Ors.). The said appeal which was against the same impugned order was disposed of with the following directions:

"We, therefore, dispose of this appeal with a direction that the appellants will appear before the Additional Collector Araria on 26th of August, 2019 and it shall be open to the Additional Collector, Araria, to proceed with the matter in accordance with law.

The appeal is accordingly disposed of."

The present appeal is also disposed of on the same terms subject to the modification that the appellant shall appear before the Additional Collector, Araria on the date fixed as in the case of Lakshmi Prasad Nayak aforesaid.
