2. The petitioner is apprehending arrest in connection with Jamui P.S. Case No. 207 of 2025, dated 08.04.2025, lodged under Sections 110, 118(1), 117 and 3(5) of the Bhartiya Nyaya Sanhita, 2023 (hereinafter referred to as "BNS, 2023").

3. As per the prosecution, FIR has been lodged against two named accused persons, including the present petitioner, alleging that the petitioner assaulted the victim, causing injuries to the victim's head and leg.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He further submits that the petitioner's name has been falsely implicated in this case due to dirty village politics. He specifically submits that the victim is a habitual consumer of illegal ganja, whereas

He further submits that while the petitioner was at his shop, the victim came and started demanding clothes for the purpose of consuming ganja. When the petitioner opposed such demand, the victim left the shop, and while returning, he fell down and sustained injuries. He also submits that, upon a minute reading of the FIR, it appears to be based on hearsay. Furthermore, he submits that the criminal antecedent of the petitioner is clean.

5. Learned APP for the State opposes the prayer for bail of the petitioner.

6. As such, in the present facts and circumstances of this case, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the Trial Court within a period of 4 weeks from today, on furnishing bail bond of Rs.30,000/- (Rupees Thirty Thousand) as mentioned in Section 2(1)(d) of the BNSS, 2023 to the satisfaction of Chief Judicial Magistrate, Jamui, in connection with Jamui P.S. Case No. 207 of 2025, subject to the conditions as laid down U/s 482(2) of the BNSS, 2023.
