JUSTICE SUDHIR SINGH ORAL ORDER 19-08-2015 The petitioner is languishing in custody since 28.11.2014 in connection with Chausa P.S. Case No. 144 of 2014 for the offences instituted under Sections 302/34 of the I.P.C. and 27 of the Arms Act.

Heard learned counsel for the petitioner and learned counsel for the State.

The prosecution story, in brief, is that the petitioner alongwith other co-accused persons named in the F.I.R. committed spot murder by surrounding and firing shots upon the deceased brother of the informant, namely, Bikash Singh on a lonely place while he was coming back on a motorcycle after meeting from his sister of brother-in-law from village Yogiraj, P.S. Puraini, DistrictMadhepura. The informant has further alleged that motive of the

No.24665 of 2015 (3) dt.19-08-2015 2/2 occurrence is as previously the petitioner and other accused persons had committed murder of his father, namely, deceased Satan Singh for which they were in custody and after releasing from the jail custody they have again committed murder of the brother of the informant, namely, Bikash Singh. It has been submitted on behalf of the petitioner that the petitioner is in custody since 28.11.2014 and the charge sheet has been submitted in the present case. As per prosecution case, general and omnibus allegation has been made against the petitioner. No specific injury is attributed against the petitioner. On behalf of the State it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M. Ist Class, Udakishunganj, Madhepura, in connection with Chausa P.S. Case No. 144 of 2014.
