The petitioner seeks bail in Sarmera P. S. Case No. 57 of 2016, G.R. No. 1764 of 2016 instituted for the offence under Section(s) 409 and 420 of the Indian Penal Code. In the written report, it is alleged that informant, who was the incharge headmaster of the school, as mentioned in the written report, has withdrawn the money for the financial year 2006-07 totaling Rs 6,36,290/-. But, construction was not completed and only work up to casting of roof was done. Learned counsel for the petitioner has submitted that petitioner has completed the work which has been allotted to him. In this regard, leaned counsel for the petitioner has filed

Patna High Court Cr.Misc. No.61674 of 2018(3) dt.26-10-2018 2/2 supplementary affidavit bringing on record the utility certificate which is annexed as Annexure-A to the supplementary affidavit and has made further demand of the money vide Annexure-B, The other accused persons with similar allegation, namely, Rakesh Kumar has been granted regular bail by coordinate Bench of this Court vide order dated 3.2.2017 passed in Cr. Misc. no. 48872 of 2016.

Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the ACJM-IV, Biharsharif,(Nalanda) in connection with Sarmera P. S. Case No. 57 of 2016, G.R. No. 1764 of 2016 subject to the condition that both the bailers shall be the close relative of the petitioner. (Sanjay Priya, J) shyambihari/- U T
