KUMAR ORAL ORDER 22-11-2018 Heard learned counsel for the petitioner, learned counsel for the State and learned counsel for the Informant. The Petitioner seeks bail in Chainpur P.S. Case No. 35 of 2018 registered for the offence punishable under Sections 448, 384, 386, 307, 504,506/34 of the Indian Penal Code. Allegation is of demanding ransom from the Informant by FIR named accused including petitioner and when he denied three named accused fired upon him. It has been submitted on behalf of the petitioner that Informant did not sustain any injury and he has been falsely implicated in this case due to local village politics. Petitioner is in custody since 30.06.2018 and there is no allegation of firing made against him.

Learned counsel for the Informant vehemently

Patna High Court Cr.Misc. No.63372 of 2018(4) dt.22-11-2018 2/2 opposes the prayer for bail.

Considering nature of allegation, I am not inclined to enlarge the petitioner on bail at this stage. Hence, the prayer for bail of the petitioner is rejected.

However, it is observed that petitioner would be at liberty to renew his prayer for bail after completing 9 months of Jail custody.
