JUSTICE HEMANT GUPTA ORAL ORDER 06-10-2016 The present is an application for grant of anticipatory bail under Section 438 of the Code of Criminal Procedure to the petitioner in respect of Sultanganj P.S. Case No. 216 of 2015 dated 21.12.2015 registered for the offences punishable under Sections 399 and 402 of the Indian Penal Code and Sections 25 (1-b)a, 26 and 35 of the Arms Act. The petitioner is named in the F.I.R. The petitioner was part of group of five persons, out of which Suraj Kumar had country made pistol, whereas other had daggers and knives. The accused persons were said to be planning to commit robbery. Keeping in view the allegations levelled against the petitioner, I do not find that any case is made out for grant of anticipatory bail. Accordingly, the present application is dismissed.
