The petitioner apprehends his arrest in Dhanaha P.S. Case No. 03 of 2017 instituted for the offence under Section (s) 272, 273 of the Indian Penal Code and Section 30(A) of the Bihar Excise Act.
It has been submitted that petitioner is owner of the vehicle in question from which foreign liquor has been recovered.
From the written report as well as the seizure list, it is clear that petitioner was not present at the spot. None of the accused has disclosed the name of this petitioner. It appears from the First Information Report that apprehended accused Tufani Baitha disclosed that he brought the liquor from Gorakhpur
Patna High Court Cr.Misc. No.7431 of 2017 (2) dt.22-02-2017 2/2 to deliver the same to co-accused Munna Prasad and Pintu Prasad. It has been mentioned in para 3 of the petition that petitioner has got no criminal antecedent. In the facts and circumstances of the case, the prayer of the petitioner for anticipatory bail is allowed. In the event of surrender/arrest of the petitioner, above named, within six weeks from today in connection with Dhanaha P.S. Case No. 03 of 2017, he shall be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Bagaha, West Champaran, subject to the conditions as laid down under Section 438(2) of Cr.P.C.
