====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 10-05-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State. No one appears on behalf of the informant. The petitioner seeks bail in connection with Kotwa P.S. Case No. 75 of 2021 registered under Sections 394, 307 of the Indian Penal Code read with Section 27 of the Arms Act. Learned counsel for the petitioner submits that petitioner is in custody since 28.07.2021, charge-sheet has been submitted in the case, has antecedent of two cases and the informant alleges that Ranjay Yadav (Petitioner) alongwith four unknown persons trying to snatch his bag containing Rs. 2,00,000/- and when miscreants could not succeed in snatching the bag, the petitioner opened three round of firing from his pistol out of which one shot hit in his left thigh causing injury, on which the informant alarmed and the villagers gathered and

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case, It is submitted that the petitioner is co-villagers and is known to the informant and, thus, he could not have committed an occurrence knowing that the informant would identify. It is further submitted that it is alleged that the petitioner fired but the firing hit the informant on his leg and not of any vital part of the body and the injury has been found simple in nature. The learned A.P.P. for the State opposes the prayer for bail of the petitioner.
Considering the fact that the petitioner is in custody since 28.07.2021, charge-sheet has been submitted in the case and the injury is on non vital part of the body and is simple in nature, let the petitioner above named is directed to be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Kotwa P.S. Case No. 75 of 2021 with a condition that one of the bailors shall be the father of the petitioner namely Hardeo Rai. The petitioner shall be released after framing of
