====================================================== CORAM: HONOURABLE MR. JUSTICE HARISH KUMAR ORAL ORDER 15-09-2023 Heard Mr. Bindeshwar Prasad Singh, learned counsel for the petitioners and learned APP for the State.

2. The petitioners presses the present application for modification of the order dated 27.07.2023 passed by this Court in Cr. Misc. No. 37815 of 2023 in connection with Bela Ganj P.S. Case No.77 of 2021, whereby while allowing the privilege of anticipatory bail to the petitioners one of the condition was

Patna High Court CR. MISC. No.62502 of 2023(2) dt.15-09-2023 2/2 imposed that "one of the bailor shall be own/close family members of the petitioner".

3. It has been submitted that on account of land dispute all the family members of the petitioners have been made accused in this case and others in their family members who are closely associated with the petitioners are not in position to stand on the position of bailor.

4. Considering the submissions made on behalf of the petitioners, the order dated 27.07.2023 imposing the condition that "one of the bailor shall be own/close family members of the petitioners" be read as "one of the bailor shall be villager of the petitioners".

5. The time prescribed earlier for furnishing bail bond, be extended for a further period of four weeks from today.

6. Accordingly, the modification application stands allowed, the order dated 27.07.2023 stands modified to the extent indicated above.
