JUSTICE AJAY KUMAR TRIPATHI ORAL JUDGMENT Date: 19-04-2016 Heard learned counsel for the petitioner, counsel for the university, counsel for the Respondent Nos. 4 and 5 and counsel for the college in question as well as intervener. Obviously, there is something drastically amiss with the way the college in question is being run as well as sought to be captured by handful of people by one manner or the other by certain vested interest. The effort on the part of the present petitioner is part of the same game plan to be declared as donor, so that she can join the managing committee as and when the opportunity arises. There is enough material on record that certain people

Patna High Court CWJC No.9158 of 2014 dt.19-04-2016 2/2 tried to facilitate her entry as a donor member, who were part of the dispensation and the same has been objected to by the managing committee, which is in charge of the affairs, which, obviously, is being contested by the petitioner.

It is also available on record that the so called donation made by the petitioner has already been returned by the college on a decision of the managing committee but she has refused to receive the same. That is another aspect.

In such controversial circumstances, there cannot be any mandamus on the university to declare the petitioner as donor member of the college in question.

Writ application is dismissed.
