JUSTICE DINESH KUMAR SINGH ORAL ORDER 30-06-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 147,148,149,447,427,379,353,109,337,338,332,333,323,324,326, 307,329 and 506 of the Indian Penal Code.
It is alleged that the informant being Circle Officer of K. Nagar received information that Adiwasi people under the leadership of Rekha Devi gathered in the premises of Pragyan Bihar Balika Vidyalaya and are taking forceful possession of the same. The police reached to the place of occurrence on the information from the informant, thereafter the mob pelted stone causing injury to the police personnel leading to the registration of the FIR against 19 named 50-100 unnamed persons. The petitioner
Patna High Court Cr.Misc. No.25034 of 2015 (2) dt.30-06-2015 2/2 is named accused. The accusation is of damaging the articles of the school.
It is submitted by the learned counsel for the petitioner that the accusation is general and omnibus against the mob and Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. It is further submitted that other co accused has been granted anticipatory bail vide Cr. Misc. No. 8059 of 2015 and 32807 of 2014.
Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned JM Ist Class, Purnea in connection with K. Nagar P.S. Case No. 569 of 2013 subject to the conditions as laid down under Section 438(2) Cr.P.C.
