The petitioner seeks bail in Chiraiya P.S. Case No. 244 of 2016 instituted for the offence under Sections 147, 148, 149, 323, 324, 307, 302, 427, 504 and 506 of the Indian Penal Code.
It is alleged in the written report that petitioner along with other co-accused persons had brutally assaulted the father of the informant with bricks, stone, Fathha etc., on account of which he died on the spot.
Case diary has been received.
Post mortem report of father of the informant is available in the case diary wherein the Doctor has found several injuries on the person of the deceased.
Patna High Court Cr.Misc. No.61468 of 2018(3) dt.19-11-2018 2/2 In the written report there is serious allegation against the petitioner of assaulting father of the informant brutally along with other accused persons.
Therefore, this Court is not inclined to grant bail to the petitioner at this stage.
Prayer for bail of the petitioner stands rejected. The trial court is directed to expedite the trial and make efforts to conclude the same as early as possible preferably within a period of nine months from the date of receipt of this order.
