Public Prosecutor for the State and also heard learned counsel for the informant.

Petitioner seeks bail in a case registered under sections 420, 406, 323 and 504 of the Indian Penal Code.

Originally, informant filed complaint case which was converted into police case. Accusation against the petitioner is that he took camera of the informant on hire but did not make payment and issued a cheque which was subsequently got stopped by the petitioner. The complaint petition, which was converted into police case, goes to show that so-called deed of agreement was executed at Mumbai and after that informant alleged that the petitioner came at Muzaffarpur and abused and assaulted him.

The submission on behalf of the petitioner is that, as a matter of fact, petitioner had taken some loan from the informant who was money lender and at the time of taking loan, petitioner had given

Patna High Court Cr.Misc. No.31181 of 2016 (2) dt.12-08-2016 a cheque to the informant as a security but even after full payment, informant started pressurizing the petitioner to cough up more money resulting in filing of the present case.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Muzaffarpur in Sadar P.S. Case no. 46/2016.
