The petitioner has preferred this application for grant of regular bail in a case registered under sections 302, 147, 148 and 149 of the Indian Penal Code.

As per the prosecution case, it is stated that as a result of land dispute, while the informant's brother was returning home, the six named accused persons including the petitioner herein assaulted the informant's brother as a result of which he died on way to the hospital.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case because of land dispute between the parties. The manner of occurrence is other than what has been narrated in the F.I.R. The

Patna High Court CR. MISC. No.67963 of 2021(2) dt.29-04-2022 2/2 allegations are general and omnibus in nature. The petitioner is in custody since 10.9.2021 and has no criminal antecedent. Chargesheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the general and omnibus allegation against the petitioner in the F.I.R., the petitioner having remained in custody for 7 months and chargesheet having been submitted in the case, the Court directs the petitioner to be enlarged on bail in connection with Guthani P.S. Case no.18 of 2014 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Siwan.
