JUSTICE MADHURESH PRASAD ORAL ORDER 02-02-2023 Heard learned counsel for the petitioner as well as the learned Additional Public Prosecutor (for brevity 'APP') for the State. The petitioner seeks bail in a case registered for the offence punishable under Section 364 of the Indian Penal Code (for brevity 'IPC').

Some unknown miscreants are said to have kidnapped the mother of the informant and committed rape against her. As per instructions obtained from the Superintendent of Police, Gaya, learned counsel for the APP submits that on 17.02.2023, i.e., next date fixed in the matter, Investigating Officer (for brevity 'I.O') and Doctor are most likely to be examined. In view of such submissions, the Court, considering the stage of trial, which is on the verge of conclusion, is not inclined to exercise jurisdiction for grant of bail to the petitioner. Let the trial Court conclude the trial expeditiously, without any undue delay, and preferably within two (2) months. Application is disposed of.
