JUSTICE SUDHIR SINGH ORAL ORDER 17-07-2015 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 406 of the Indian Penal Code. The informant has alleged that on 3.8.2010 he met the petitioner through his relation Naushad Alam and it is said that on 3.9.2012 he gave Rs. 1.25 lacs to the petitioner for service in Dubai as a Supervisor but after lapse of one and half year the complainant was neither provided with job nor the money was returned to him.
It has been submitted on behalf of the petitioner that no specific allegation has been made against the petitioner. It is further submitted that there is no documentary prove in respect
Patna High Court Cr.Misc. No.25985 of 2015 (2) dt.17-07-2015 2/2 to the allegation made by the complainant. Further it has been submitted that the petitioner has no criminal antecedent. It is also submitted on behalf of the petitioner that he is ready to deposit an amount of Rs. 25,000/- in the court below, which shall be subject to final disposal of the case.
On behalf of the State, it has been submitted that the petitioner is named in the FIR and there is specific allegation against the petitioner.
Considering the aforesaid facts, the above named petitioner is directed to deposit an amount of Rs. 25,000/- in the court below, which shall be subject to final disposal of the case, and on doing so, in the event of his arrest or surrender in the court below within a period of four weeks, he shall be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Gopalganj, in connection with Complaint Case No. 273 of 2012 ( Trial No. 3442 of 2015), subject to the conditions as laid down u/s 438(2) Cr.P.C.
