The present petition, at the behest of the petitioner, for grant of regular bail is a second attempt inasmuch as his earlier prayer for grant of regular bail in connection with Bakhtiyarpur P.S. Case No. 540 of 2017 under Section 364(A) of the Indian Penal Code had been rejected vide order dated 28.6.2018 passed in Criminal Miscellaneous No. 21294 of 2018.

The allegation against the accused persons is of kidnapping a minor boy, which is a very serious offence. The prayer of the petitioner for grant of bail was rejected by an order dated 28.6.2018, after this Court had perused the case diary and it was found that the kidnapped victim boy was

No.55832 of 2019(2) dt.04-09-2019 2/2 recovered from the house of the petitioner, hence, this Court was of the view that the petitioner's involvement in the alleged crime is apparent from the records, thus, the petitioner did not deserve to be granted the privilege of bail. In such view of the matter, the case of the petitioner for grant of regular bail was rejected. The learned counsel for the petitioner has not been able to demonstrate any change in circumstance from the date the prayer of the petitioner for grant of regular bail was rejected on 28.6.2018, till date.

Having regard to the facts and circumstances of the case, there being no change in circumstance and the petitioner being alleged to have committed a serious offence, I do not find any reason to reconsider the case of the petitioner for grant of regular bail, hence, the present petition stands rejected.
