Mr. Binod Kumar, APP ====================================================== CORAM: HONOURABLE DR. JUSTICE RAVI RANJAN ORAL ORDER 06-10-2018 I have heard learned counsel for the petitioners and the State.

The petitioners seek bail in a case registered for offences punishable under sections 30 (a) /38(i) (ii)/45 and 47 of the Bihar Prohibition and Excise Act, 2016. It is contended that, as per allegation, about 237 litres of foreign liquor were recovered from a Martui Swift Car. It is further contended that petitioner no. 1 is father of the owner of the said vehicle and has been arrested from his house and he has been falsely implicated in this case. The petitioner no.2 claims that he is driver of the vehicle and has no concern with the seized liquor. Petitioners claim that they are having clean

Patna High Court Cr.Misc. No.57984 of 2018(3) dt.06-10-2018 2/2 antecedents and are in custody since 22.07.2018. Having regard to the facts and circumstances of the case, the above named petitioners are directed to be released on bail on their furnishing bail bond of Rs. 10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of Special Judge, Excise, Samastipur in connection with Rosera P.S. Case No. 271 of 2018.

If the petitioners, after their release in this case, are again found involved in similar nature of cases then the concerned court would be at liberty to take steps for cancellation of their bail bonds.
