The petitioners seek bail in Mohania P.S. Case No. 445/2018, instituted for the offences under Sections 147, 148, 149, 447, 307 and 504 of the Indian Penal Code read with Section 27 of Arms Act.

It is alleged in the written report that while the informant along with two others was going to attend call of nature, the petitioners along with co-accused Shital Singh made firing causing injury to them.

Learned counsel for the petitioners has submitted that no specific allegation has been levelled against these

Patna High Court Cr.Misc. No.57475 of 2018 (2) dt.29-10-2018 2/2 petitioners as to whose firing hit whom. Injury report is annexed as Annexure-P/5 to the bail petition, which shows that injuries found on the persons of injured are simple in nature. There is general and omnibus allegation against these petitioners. Other accused persons with similar allegation have already been granted anticipatory bail by a Co-ordinate Bench of this Court in Cr. Misc. No. 55683/2018 dated 09.10.2018. Petitioner is in custody since 18.07.2018.

Considering the aforesaid fact and circumstances, prayer of the petitioners for grant of bail is allowed. Let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Kaimur at Bhabhua in connection with Mohania P.S. Case No. 445/2018, subject to the conditions that both the bailors shall be the close relative of the petitioners. (Sanjay Priya, J.) Rakhi U T
