2. The petitioner apprehends his arrest in a case registered for the offence under Sections 103(1), 61(2) of the Bhartiya Nyaya Sanhita, 2023 and Section 27 of the Arms Act.
3. As per F.I.R. co-accused (1) Afsar Khan, (2) Sharukh Khan, (3) Akhtar Ali @ Golden, (4) Ameer Jalal, & (5) Aftab Mallik fired bullets upon the husband of the informant, as a result of which, he died due to bullet injury. The informant suspects that this petitioner alongwith 9 other co-accused persons have conspired with aforesaid five accused and got the husband of informant killed.
4. Learned counsel for the petitioner submits that
Patna High Court CR. MISC. No.55724 of 2025(2) dt.25-08-2025 2/2 specific accusation of firing is against other co-accused persons. Petitioner is only alleged to be conspirator. Informant is not eyewitness to the occurrence and only suspicion has been raised against this petitioner.
5. Learned A.P.P. for the State and learned counsel for the informant opposed the bail petition.
6. Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of arrest/surrender within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. - IV, Patna in connection with Phulwarisharif P.S. Case No. 779 of 2025, subject to condition as laid down under Section 482(2) of the Bhartiya Nagrik Suraksha Sanhita, 2023. (Prabhat Kumar Singh, J) anay U T
