ANJANA PRAKASH ORAL JUDGMENT Date: 04-01-2016 Heard learned counsel for the Petitioner and the State. The Petitioner seeks quashing of the order dated 27.3.2014 passed by the Sub Divisional Judicial Magistrate, Pupri at Sitamarhi, in Complaint Case No. C-1 164 of 2011, Trial No. 780 of 2014.
The counsel for the Petitioner produces a Bank Draft No. 000687 dated 18.12.2013 for a sum of Rs.1,50,000/- as undertaken by him earlier. The same is handed over to the counsel for the Informant who receives and signs in the margin of order sheet in token of the receipt of the same.
In view of such transaction as agreed, the application is
Patna High Court Cr.Misc. No.22599 of 2014 dt.04-01-2016 2/2 disposed off with a direction to the Petitioner to further pay a sum of Rs.1,50,000/- on the date of final decree of divorce on grounds of compromise is passed by the Principal Judge, Family Court, Sitamarhi. Let this order be communicated to the Principal Judge, Family Court, Sitamarhi, for its compliance.
Also in the interest of the Parties, the further Proceedings of Complaint Case No. C1-164 of 2011, Trial No. 780 of 2014 pending before the Sub Divisional Judicial Magistrate, Pupri at Sitamarhi, Misc. Case No. 36 of 2012 pending before the Principal Judge, Family Court, Sitmarhi, and Complaint Case No. 611 of 2012 pending before Shri R.S. Pandey, Judicial Magistrate, 1st Class, Patna City, are hereby, dropped.
