03. 29.09.2016 Heard learned counsel for the petitioner, complainant and the State.
The petitioner apprehends his arrest in a case registered for the offence punishable under Section 420 of the Indian Penal Code.
It is contended on behalf of the petitioner that he allegedly stood as a witness on the agreement for sale of land but the sale deed of only part of the land was executed. However, the person who has received the amount of agreement has already been granted bail by a Co-ordinate Bench of this Court vide
Patna High Court Cr.Misc. No.37911 of 2016 (3) dt.29-09-2016 order dated 16.09.2016 passed in Cr. Misc. No. 39477 of 2016 on the condition that he will return the remaining amount of Rs. 5,00,000/- (Five Lacs) to the complainant within four months. Having regard to the facts and circumstances of the case, let the petitioner, namely, Manoj Kumar be released on bail in the event of his arrest/surrender before the court below within a period of six weeks from today in connection with Complaint Case No. 1220(C)/2015, on furnishing bail bond of Rs.10,000 (Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of Shri Ranjeet Prasad, Judicial Magistrate, 1st Class, Danapur, Patna or his successor subject to the conditions as laid down under sub-section (2) of Section 438 of the Code of Criminal Procedure.
