The petitioner apprehends his arrest in Sangrampur P.S. Case No. 31 of 2016 registered under sections 379 and 420 IPC, Rule 40(1) (7) of the Bihar Minor Mineral Concession Rules, 1972 and Rule 8 of the Bihar Minerals(Prevention of Illegal Mining, Transportation and Storage) Rules, 2003.
In brief, the prosecution case is that tractors carrying sand during the period when such mining of sand was stayed were seized. The petitioner owns one of the tractors. It is submitted that the petitioner has clean antecedents. Two other accuseds having identical allegation have been released
Patna High Court Cr.Misc. No.31024 of 2016 (2) dt.11-08-2016 2/2 on anticipatory bail by this Court vide order dated 31.05.2016 (Annexure-2).
Considering the facts and circumstances of the case, let the petitioner, named above, in the event of arrest/surrender within four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of CJM, Motihari in Sangrampur P.S. Case No. 31 of 2016 on condition that one of the bailors shall be his own close family member. He shall appear in person on each date fixed at the trial. In case of non appearance thereat on two dates consecutively, his bail bonds shall stand cancelled.
