JUSTICE SUDHIR SINGH ORAL ORDER 20-07-2015 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 406, 353 and 34 of the Indian Penal Code.
It is alleged by the informant that the petitioner was posted as Block Education Officer at Goh and he was suspended and facing departmental proceeding. The petitioner failed to hand over charge of his office and there was an obstacle in way of government functioning.
It has been submitted on behalf of the petitioner that the petitioner was put under suspension and during suspension he was directed to hand over charge. It has been pointed out by the learned counsel for the petitioner that vide Annexure 2 he went to
Patna High Court Cr.Misc. No.26261 of 2015 (2) dt.20-07-2015 2/2 hand over charge but as there was no one to take the charge, hence could not hand over charge. Subsequently, in the departmental proceeding he has been exonerated by the Enquiry Officer, which is evident from Annexure 4 to the present application.
On behalf of the State, it has been submitted that that the petitioner is named in the FIR.
Considering the aforesaid facts, let the above named petitioner, in the event of his arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M.,Daudnagar, Aurangabad, in connection with Goh P.S.Case No.212/2013, subject to the conditions as laid down u/s 438(2) Cr.P.C.
