The petitioner seeks bail in connection with Buxar Town P.S. Case No. 347 of 2019 registered for the offence punishable under Section 307/34 of the Indian Penal Code and Section 27 of the Arms Act.
The prosecution story in brief is per report of Jail Superintendent, Central Jail, Buxar dated 21.04.2019 is that he received information from SAP constables Dharam Singh and Devi Lal at about 8:30 P.M. three criminal made fire four rounds near northern gate of the jail which hit the wall. Learned counsel for the petitioner submits that the

No.53050 of 2019(4) dt.16-11-2019 2/2 petitioner is not named in the F.I.R. and on the confessional statement of co-accused Rahul Kumar, petitioner's name has transpired in this case. Learned counsel for the petitioner further submits that the co-accused Rahul Kumar has been granted regular bail by the court below. He further submits that the petitioner has got no criminal antecedent. In the facts and circumstances of the case, let the petitioner above named be released on bail after framing of the charge on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Buxar in connection with Buxar Town P.S. Case No. 347 of 2019.
