JUSTICE SUDHIR SINGH ORAL ORDER 21-07-2015 Heard learned counsel for the petitioner and learned A.P.P. appearing for the State The petitioner is in custody in a case registered under Sections 366A/34 of the Indian Penal Code. The prosecution case, in brief, is that on 14.02.2015 one Munna Singh filed a written report before the Officer-in-Charge, Mufassil P.S. alleging that his daughter Nisha Kumari, a student of I.A. has not returned from the coaching class and on search it has been learnt that two persons namely, Chandan Choudhary and Prem Choudhary took his daughter and fled away with an intention to marry her. On the basis of the said written report, Wazirganj (Tankuppa) P.S. Case No. 39 of 2015 has been instituted. It is submitted on behalf of the petitioner that the
Patna High Court Cr.Misc. No.25057 of 2015 (2) dt.21-07-2015 petitioner is in custody since 20.02.2015 and the charge sheet has been submitted in the case. A statement of the victim under Section 164 Cr.P.C. has been annexed as Annexure-2 to the present application and from perusal of the same it appears that the victim girl has admitted that she had left the house on her own will with an intention to marry the petitioner.
On behalf of the State it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya in connection with Wazirganj (Tankuppa) P.S.
