Petitioners apprehend their arrest in a case registered for the offence punishable u/s 307, 379 and some other ancillary Sections of the Indian Penal Code.

As per the prosecution case, petitioner No.2 assaulted the informant by means of Fasuli (sickle) as a result of which he sustained grievous injury.

Learned counsel appearing for the petitioners submits that petitioners are innocent and have falsely been implicated in the case. So far petitioners No. 1 and 3 are concerned, there is

Patna High Court CR. MISC. No.67703 of 2021(2) dt.18-07-2022 2/2 general and omnibus allegation against them. There is case and counter case in which both sides sustained injuries. Learned counsel appearing for the State opposes the prayer for anticipatory bail.

Taking into consideration the fact that there is direct and specific accusation against petitioner No.2 of assaulting the informant and injury has been found to be grievous in nature, his prayer for anticipatory bail is refused.

Considering the facts of the case and nature of accusation against the petitioners No. 1 and 3, let the petitioners, No. 1 and 3 above named, in the event of their arrest/ surrender within a period of six weeks from today shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st class, Gaya in connection with Tekari PS case No. 54/2021, subject to conditions laid down u/s 438(2) of the Cr. P. C.
