====================================================== CORAM: HONOURABLE MR. JUSTICE ARVIND SRIVASTAVA ORAL ORDER 02-01-2019 Heard learned counsels for the petitioner and the State.

Petitioner had earlier moved this Court for grant of bail in Cr. Misc. No. 42816 of 2018, which was rejected vide order dated 19.07.2018 (Annexure-1).

Learned counsel for the petitioner submits that petitioner was not arrested on the spot nor anything incriminating was recovered from his conscious possession. He further submitted that there is no progress in the case before the court below as the case is still pending for appearance. Petitioner is in custody since 06.05.2018.

Learned Addl. P.P. appearing for the State opposed the prayer for bail of the petitioner.

Considering the nature of allegations levelled, the

Patna High Court Cr.Misc. No.62116 of 2018(5) dt.02-01-2019 2/2 materials available on record and the submissions advanced on behalf of the parties, this Court is not inclined to grant bail to the petitioner. His prayer for bail is, therefore, rejected. However, the trial court is directed to expedite the trial of this case and conclude it expeditiously within a period of six months from today.
