2. The petitioner is in custody in connection with Sachiwalay P.S. Case No. 111 of 2025 for the offence punishable under sections 336(3), 340(2), 61(2) of the BNS lodged on 23.05.2025 by the informant, Manoj Kumar Jha.

3. As per the prosecution story, the informant the Under Secretary, Law Department, Bihar, Patna alleged that the petitioner joined the post of Data Entry Operator on the basis of letter which after verification, was found to be forged. This led to the FIR.

4. Learned counsel for the petitioner submits that he was unemployed person, in need of employment, got a call allegedlyfrom Beltron to deposit Rs. 1,65,000/-, the same was deposited in the Axis Bank. He got a joining letter, went to the

Patna High Court CR. MISC. No.56195 of 2025(2) dt.12-08-2025 2/3 place little realizing that it is a forged letter. He has suffered by being in custody since 24.05.2025 having no criminal antecedent.

5. Learned APP opposes the prayer for bail submitting that without ensuring and/or appearing any interview, the petitioner went to join on the basis of letter, naturally, he had to suffer.

Considering the submissions of the parties as also the predicament of the unemployed persons who get lured by the offer to provide job for consideration amount, pay huge amount, ultimately come in the judicial net as happened in the present case. He is in custody since 24.05.2025 having no criminal antecedent, in that background, this Court is inclined to extend him the privilege of bail with conditions.

7. Let the petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of like amount each to the satisfaction of learned A.C.J.M-II, Patna in connection with Sachiwalay P.S. Case No. 111 of 2025 subject to the following conditions:

(i) one of the bailor should be the family member/relative of the petitioner who shall provide official document to show his/her bona fide;

Patna High Court CR. MISC. No.56195 of 2025(2) dt.12-08-2025 3/3 (ii) the petitioner shall appear on each and every date before the Trial Court and failure to do so for two consecutive dates without plausible reason will entail cancellation of his bail bond by the Trial Court itself;

(iii) the petitioner shall in no way try to induce or promise or threat the witnesses or tamper with the evidences, failing which the State shall be at liberty to take steps for cancellation of the bail bonds;

(iv) the petitioner shall desist from committing any criminal offence again, failing which the State shall be at liberty to take steps for cancellation of his bail bonds. (Rajiv Roy, J) Vijay Singh/- U T
