Petitioners are apprehending their arrest in connection with Gogri (Paura OP) Ps Case No.154 of 2019 , registered for offences punishable under Sections 307, 447, 506/34 of the Indian Penal Code and Section 27 of the Arms Act,. As per FIR petitioner no.1 is order giver and against the
Patna High Court CR. MISC. No.56383 of 2019(3) dt.16-11-2019 2/3 petitioner nos. 5 and 6 there is allegation of firing but that does not hit anybody . So far petitioner no.3 and 4 are concerned, there is allegation of firing, causing injury to one Bilash Yadav.
Submission of the learned counsel for the petitioners is that so far petitioner no.1, 5 and 6 are concerned there is allegation of causing injury to a person. So far petitioner no.3 and 4 are concerned, though there is allegation of causing injury by fire arm to Biklash Yadav but Bilash Yadav has no fire arm injury .
Heard learned A.P.P. and the learned counsel for the informant..
Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioners, above named, in the event of arrest or surrender before the learned court below, be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned CJM, Khagaria in connection with Gogri (Paura) P.S.Case No.154 of 2019 dated 8.5.2019 corespodnig to G.R.No.1165 of 2019, subject to conditions as laid down under Section 438 (2) of the
Patna High Court CR. MISC. No.56383 of 2019(3) dt.16-11-2019 3/3 Code of Criminal Procedure.
