====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 25-08-2025 Heard learned counsel for the petitioners and the State.

2. Petitioners apprehend arrest in a case registered for the offence punishable under Section 309(4) of the Bharatiya Nyaya Sanhita.

3. As per prosecution case, on 21.04.2025 at about 10:15 PM, when informant was going towards Kharagpur, on the way, some unknown miscreants riding on two motorcycles, snatched his mobile phone, cash of Rs. 14,000/- and gold ornaments and fled away.

4. Learned counsel for the petitioners submits that petitioners are innocent and have committed no offence.

No.56247 of 2025(2) dt.25-08-2025 2/2 Petitioners are not named in the F.I.R. and they have been made accused during course of investigation only on the basis of confessional statement of co-accused. No stolen article has been recovered from conscious possession of the petitioners. There is no allegation of overt act against these petitioners. Petitioners claim clean antecedent.

5. Learned A.P.P. for the State vehemently opposed the bail application.

Considering the nature of accusation and clean antecedent, this anticipatory bail is allowed and it is ordered that let the above named petitioners in the event of their arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Munger in connection with Tarapur P. S. Case No. 88 of 2025, subject to condition as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
