ANJANA MISHRA ORAL ORDER 13-09-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 14.05.2019 in connection with Case No. C2/247 of 2019 registered for the offence under Section 30 (a) of the Bihar Prohibition & Excise Act, 2016.

Learned counsel for the petitioner submits that the alleged recoveries were made not from the conscious possession of the petitioner but from his motorcycle near BP No. 341 between India and Nepal. It is further submitted that petitioner has no criminal antecedent.

Considering the aforementioned facts and circumstances and that the petitioner has clean antecedents, let

No.55205 of 2019(2) dt.13-09-2019 2/2 the petitioner, above named, be released on bail on his furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District & Sessions Judge-II cum Special Judge, Excise Act, Sitamarhi, in connection with Excise Case No. C2/247 of 2019.
