JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 21-08-2015 It is a case of gross misuse of privilege of bail. In the present application the petitioner has prayed for quashing of the order dated 13th September, 2013 passed by the learned Ad hoc Additional Sessions Judge-III, Muzaffarpur in Sessions Trial No.358 of 2008 arising out of Muzaffarpur Town P.S. Case No.279 of 1989 registered under sections 399 and 402 of the Indian Penal Code and sections 25(1-B)(a), 26, 27 and 35 of the Arms Act as also under sections 4 and 5 of the Explosive Substances Act.
Admittedly, the case was committed to the court of session in the year 1990. After commitment other co-accused persons faced trial and they were acquitted vide judgment dated
Patna High Court Cr.Misc. No.24898 of 2015 (2) dt.21-08-2015 2/2 23rd October, 2008. Since the petitioner was absconding, his case was split up. Ultimately, the trial court has declared him permanent absconder vide order dated 13.9.2013. The said order dated 13.9.2013 is under challenge in the present application. In my view, there is no illegality in the impugned order dated 13.9.2013.
Accordingly, the application, being devoid of any merit, is hereby dismissed.
