JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-11-2018 Petitioner prays for bail in connection with Siwaipatti P.S.Case No. 67 of 2018 registered for the offences punishable under Sections 272, 273, 120B of the Indian Penal Code and Sections 30(A), 38, 41 & 48 of Bihar Prohibition and Excise Act.

Allegation is of recovery of 1249 litres of liquor from the house of one co-accused and petitioner was arrested there. It further appears that petitioner is accused in one more similar type of case.

Submission of learned counsel for the petitioner is that nothing has been recovered from his possession, rather recovery has been made from the house of co-accused Ajay Kumar Chaudhary, who has been granted conditional bail vide order dated 10.10.2018 in Cr.Misc.No. 60840 of 2018 and

Patna High Court Cr.Misc. No.65366 of 2018(4) dt.27-11-2018 2/2 petitioner is in custody since 9.8.2018 and so far other case is concerned, he is on bail in that case.

Having heard both sides and in the facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Excise Act, Muzaffarpur, in connection with Siwaipatti P.S.Case No. 67 of 2018, subject to the condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
