JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 18-07-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in a case registered for the offence punishable under Section 363/34 of the Indian Penal Code.
As per the prosecution case, daughter of the informant was kidnapped by the petitioner and other accused persons. Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. As a matter of fact this petitioner has registered a case u/s 341, 342, 325, 308/34 of the IPC against the informant and other members of having been brutally beaten up and thereafter the present FIR has been lodged. It is further submitted that so called kidnapped girl was recovered from Balika Grih,
Patna High Court CR. MISC. No.67709 of 2021(2) dt.18-07-2022 2/2 Muzaffarpur and considering this fact one of the co-accused has already been granted anticipatory bail by a co-ordinate Bench of this court vide order passed in Cr. Misc. No. 55329/2021. Petitioner has got clean antecedent.
Learned counsel appearing for the State opposes the prayer for anticipatory bail.
Considering the facts of the case, nature of accusation and clean antecedent of the petitioner, let the petitioner, above named, in the event of his arrest/ surrender within a period of six weeks from today shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Muzaffarpur in connection with Ahiyapur PS case No. 465/2018, subject to conditions laid down u/s 438(2) of the Cr. P. C.
